PRIVACY POLICY
Last updated:
Built By Aliens, LLC ("we," "us," or "our") respects your privacy. This Privacy Policy sets out our practices for collecting, using, sharing, and retaining personal information in connection with our software, mobile applications, and related support services that link to this policy (the "Services"), together with your privacy rights and choices.
Built By Aliens, LLC is the legal entity responsible for the personal information described in this Privacy Policy. Nerzan Software Solutions and Embedded Elsewhere are trade names used by Built By Aliens, LLC and are not separate legal entities.
This Privacy Policy applies when Built By Aliens, LLC determines the purposes and means of processing personal information. If we process personal information solely on behalf of a business customer under an agreement with that customer, we act as a service provider or processor, and the customer's privacy notice generally governs that processing.
Different Services may use different features, service providers, permissions, and data-processing technologies. A Service may therefore provide a supplemental privacy notice describing practices specific to that Service, including the categories of information involved, third-party services or SDKs, retention practices, and available privacy controls. A supplemental notice forms part of this Privacy Policy and, if there is a conflict, controls with respect to the Service and practices it specifically describes.
1. Information we handle and how we receive it
Depending on the features you use, information may include:
- Information you provide: your name, email address, and messages when you contact us; account details where accounts are offered; and content you choose to submit through a Service.
- Technical and diagnostic information: app version, operating system, device type, IP address, error reports, and feature usage where a Service sends this information to us or its service providers for operation, troubleshooting, or improvement.
- Purchase information: where purchases are offered, transaction identifiers, purchased items, and subscription status needed to provide or restore access. For purchases processed by an app store, payment details are handled by that store under its own privacy policy.
We may receive information directly from you; automatically from your device or use of a Service; from an app store, authentication provider, or other service you choose to connect; and from service providers acting on our behalf. The applicable Service or supplemental privacy notice describes the sources relevant to that Service.
Data created or stored only on your device is not received by us unless a feature transmits it, for example when you choose to sync, share, or send information to support.
2. How information is used
We use information relevant to the Services you use to:
- Provide requested features, manage accounts where available, and restore purchases.
- Respond to questions, support requests, and other communications.
- Diagnose errors, maintain reliability, and improve functionality.
- Protect the Services against misuse, fraud, and security incidents.
- Meet applicable legal obligations and resolve disputes.
Where applicable law requires a legal basis for processing, we rely on providing the Services you request, legitimate interests such as security and service maintenance, legal obligations, or your consent, as appropriate.
Where applicable law requires consent for a particular processing activity, we request that consent separately and provide a way to withdraw it. Withdrawing consent does not affect processing that occurred lawfully before withdrawal. You can use the relevant Service's privacy controls or contact us to withdraw consent.
3. Device permissions & local storage
A feature may request access to device capabilities, such as the camera, photos, microphone, or notifications. When requesting access, we explain why it is needed for that feature. You can manage permissions in your device settings; declining a permission may prevent the associated feature from working.
Granting a device permission does not necessarily mean that information accessed through that permission is transmitted to us. Some features process information entirely on your device. Where information obtained through a device permission is transmitted to us or a third-party service, the applicable Service or supplemental privacy notice will describe that processing.
A device permission is separate from any consent required by applicable law for a particular use of personal information.
Apps may store preferences, cached files, and user-created content on your device. You can use available app controls or your device's storage settings to manage this information. Uninstalling an app may remove local data, but does not necessarily delete cloud data, device backups, or information already sent to us.
5. Sale, sharing & targeted advertising
We do not use personal information for cross-context behavioral advertising or targeted advertising unless the applicable Service specifically discloses that practice. If a Service engages in an activity treated as a "sale," "sharing," or targeted advertising under applicable law, its supplemental privacy notice will identify that practice and explain the available opt-out methods.
6. Do Not Track & privacy preference signals
Some browsers provide a "Do Not Track" ("DNT") setting. Because there is no universally accepted standard for interpreting DNT signals, our Services do not currently respond to DNT signals unless required by applicable law.
Where applicable law requires us to recognize a legally valid opt-out preference signal, such as Global Privacy Control, we honor that signal for the processing to which the requirement applies.
A Service's supplemental privacy notice identifies any third-party analytics, advertising, or similar technologies that may collect information over time or across different services.
7. Retention & security
We retain personal information only for as long as reasonably necessary for the purpose for which it was collected, subject to applicable legal requirements. The retention period depends on the type of information and its purpose. For example, account information may be retained while an account remains active and for a limited period afterward; support communications may be retained as needed to resolve the request and maintain appropriate business records; diagnostic information may be retained for a period appropriate for troubleshooting and reliability analysis; and transaction records may be retained as required for accounting, tax, fraud-prevention, or legal purposes.
When information is no longer reasonably necessary, we delete, de-identify, or otherwise dispose of it as appropriate. Residual copies may remain temporarily in backups until those backups are overwritten through our normal retention cycle. A Service may provide more specific retention information in its supplemental privacy notice.
We use reasonable technical and organizational measures to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
We maintain procedures for evaluating suspected security incidents and will provide notifications of a qualifying data breach where and as required by applicable law.
8. Your choices & deletion requests
Depending on your location and the law applicable to the relevant processing, you may have rights to request access to, correction of, deletion of, or a portable copy of certain personal information; to object to or restrict certain processing; to opt out of certain sales, sharing, or targeted advertising; to limit certain uses of sensitive personal information; to withdraw consent; or to appeal certain decisions concerning a privacy request. You may also have the right to complain to an applicable privacy or data-protection authority.
To exercise an applicable privacy right or appeal a decision concerning your request, email [email protected] with the app name, the nature of your request, and the email address or account identifier associated with it. Do not send passwords or payment card details. We will respond within applicable legal time limits.
We will not unlawfully discriminate against you for exercising an applicable privacy right.
Where permitted by law, an authorized agent may submit a request on your behalf. We may take reasonable steps to verify your identity, the authority of an agent, and the applicability of the requested right before acting on a request.
If a Service offers an account, you may request deletion of the account and associated personal information through this contact address, or use an account-deletion control where provided in the app. Some records may need to be retained for legal, security, or fraud-prevention purposes; where applicable, we will explain those exceptions. Copies in backups may remain until the backups expire under the relevant retention cycle.
Deleting an account or uninstalling an app does not necessarily cancel an app-store subscription. Manage subscriptions through the store where you purchased them.
If your request concerns information we process solely for a business customer, please contact that customer. We assist the customer with requests in accordance with our agreement and applicable law.
9. Children's privacy
The Services covered by this general Privacy Policy are intended for a general audience and are not directed to children under 13. We do not knowingly collect personal information from children under 13 in a manner requiring parental consent under applicable law.
If we learn that we have collected personal information from a child in circumstances requiring parental consent and the required consent was not obtained, we will take appropriate steps to delete or otherwise address the information as required by law. Please contact us if you believe this has occurred.
If a Service is designed for children, directed to children, or operated as a mixed-audience service subject to special children's privacy requirements, that Service will provide an appropriate supplemental notice and any required parental-consent or age-assurance mechanisms.
10. International processing
Built By Aliens, LLC is based in Washington State, United States. Accordingly, personal information may be processed in the United States and in other countries in which our service providers operate. Those countries may have privacy laws different from those in your country of residence.
Where applicable law requires a particular safeguard or transfer mechanism for international transfers of personal information, we use an applicable lawful mechanism, which may include an adequacy decision, contractual safeguards, or another mechanism recognized by applicable law. Contact us for information about safeguards relevant to your data.
If European Economic Area, United Kingdom, or other jurisdiction-specific privacy requirements apply to a particular Service, additional information concerning legal bases, international transfers, local representatives, or supervisory authorities may be provided in that Service's supplemental privacy notice.
11. Changes to this policy
We may update this policy as the Services or our practices change. We will post the revised policy here and update the date above. Where required, we will provide additional notice or request consent before applying a material change.
